(SDMC) services provide a time efficient, convenient, and confidential
forum for the informal resolution of disputes arising out of wills,
trusts and other probate matters.
All types of issues can be resolved effectively through mediation
such as disputes involving property interests
in decedent estates, including wills and trusts, conflicts
among beneficiaries, allocation of tangible personal property, and
creditors’ claims. In conservatorship
and guardianship proceedings, disputes
regarding the selection of the conservator/guardian and personal
care intervention can be resolved among family members. In the area
of estate planning, involving wills
and trusts, couples can mediate conflicts regarding the characterization
or testamentary disposition of marital assets. Mediation may also
be useful in helping families plan for
the eventual succession of special assets such as family businesses
or farms.
